1. Seller Identification
OG USA DEVELOPMENT corporation, with principal office located at 205 S Mill St Suite 202, Aspen, CO 81611, USA and with tax ID 32-0576797 (hereinafter “OGIER” or “Seller”).
2. Scope
These Terms and Conditions of Sale (“Terms”) govern all purchases made through www.ogier1948.com (the “Site”) by customers located in the United States as well as customers outside the United States where OGIER offers international shipping.
3. Products
All products available for purchase are described on the Site. Images and descriptions are for illustrative purposes only and do not create any warranty or guarantee. OGIER strives for accuracy but is not responsible for typographical errors or variations.
4. Orders
By placing an order, the customer (“Customer”) affirms acceptance of these Terms. All orders are subject to availability and acceptance by OGIER, which may refuse any order at its discretion. OGIER will confirm order acceptance via email.
5. Pricing
Prices are shown in U.S. dollars (USD) and do not include sales tax, shipping fees, or (for international orders) customs duties, taxes, or additional charges imposed by destination countries.
For international orders, the Customer is solely responsible for all applicable import duties, VAT/GST, taxes, and local handling fees.
Prices are subject to change without notice, and the applicable price is that which is displayed at checkout at the time the order is placed.
6. Payment
Payment is due at the time of order placement via credit card or any other payment methods offered on the Site. Payment is processed securely. OGIER reserves the right to require additional verification or to refuse any transaction.
7. Shipping
7.1. Domestic (U.S.) Shipping
Orders are shipped to the address supplied by the Customer. Estimated delivery times will be displayed at checkout, and actual delivery times may vary depending on carrier and location.
7.2. International Shipping
OGIER offers shipping to selected countries outside the United States. Delivery times and costs vary by shipping destination.
International orders may be subject to customs inspection and additional delays.
The Customer is responsible for all import duties, VAT/GST, taxes, surcharges, and any fees imposed by the destination country’s authorities. OGIER will not be responsible for shipments held or delayed by customs nor for items confiscated or returned as a result of import restrictions.
8. Returns and Exchanges
8.1. U.S. Returns
Customers have the right to return new, unused, and unworn products within 30 days of receipt, in their original packaging, unless specifically stated otherwise (e.g., final sale or perishable goods).
To initiate a return, login to your account at www.ogier1948.com, choose the detail page for your order and mark the items you need to return. You will receive a Return Authorization Number.
8.2. International Returns
International orders may be returned within 30 days of delivery, provided items are in new and unused condition with original packaging. For international returns, potential customs and shipping fees is under the Customer’s responsibility.
Refunds for international returns cover the purchase price of the product only (original shipping, customs, and duties are non-refundable).
9. Limited Warranty
Products are covered by the manufacturer’s standard limited warranty, where applicable, and as required by U.S. law. Customers should inspect all products upon delivery and notify OGIER of any defects within 7 days of receipt.
10. Limitation of Liability
To the extent permitted by law, OGIER shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use or inability to use any product. OGIER’s maximum cumulative liability shall not exceed the purchase price paid for the product.
11. Privacy
OGIER collects and uses personal data in accordance with its Privacy Policy. By purchasing through the Site, the Customer consents to such collection and use.
12. Intellectual Property
All Site content, including trademarks, images, logos, and texts, is the exclusive property of OGIER or its licensors. No content may be reproduced, distributed, or used for commercial purposes without express written consent.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado and the United States of America, excluding its conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods CISG).
Any dispute arising under or related to these Terms shall be resolved exclusively by the courts located in [insert county/state jurisdiction], unless a different venue is required by law.
